Terms of Use
These terms cover this website and the products we sell, such as Pacifico: buying a license and using it. Work we do for clients is covered by a separate written agreement.
Who we are
Elcano is the trading name of Burak Çalık, a sole proprietorship registered at Karaağaç Mah. Conkbayırı Cad. 5/433, Büyükçekmece, Istanbul, Turkey (“Elcano”, “we” or “us”). Elcano runs this website and makes the products these terms cover, and these terms are an agreement between you and Elcano. You can reach us at [email protected], or at [email protected] about a product.
Using the site
By using the site, you agree to these terms. If you don’t agree, please don’t use it.
Use the site lawfully, and don’t:
- try to reach parts of the site, or the systems behind it, that aren’t meant for you
- disrupt or overload it, or use it to spread malware
- copy it at scale, for example by scraping
- use it to mislead anyone, for example by claiming to be Elcano
Our content
The site and its content, including its text, paintings, video, design and the Elcano name and wordmark, belong to Elcano or are used with permission, and are protected by law.
You may view the site, link to it and quote short passages with credit. Anything else, such as reusing the paintings, needs our written permission.
The paintings are imagined scenes in a period style, not historical records. The modern devices in them are deliberate anachronisms.
No offer or advice
The site describes our client work in general terms. Nothing on it is an offer to take on that work, a promise of results or professional advice for your situation. We take on client work only under a written agreement, which then governs that work.
Other sites
The site links to other sites, such as LinkedIn. We don’t control them and aren’t responsible for their content or for how they handle your data. Their own terms and policies apply.
Availability
We work to keep the site available and accurate, but we provide it as it is. We may change, pause or remove any part of it at any time, and we don’t promise that it will always be available, free of errors or up to date.
Our products
We make software, such as Pacifico, a Mac app. Each product’s website says what it does and what it needs, and these terms cover buying it and using it.
A product may come with terms of its own, which we show you before you buy or install it. Where they differ from these, the product’s own terms apply to it.
Some products work with other companies’ services and devices, as Pacifico does with Spotify and AirPlay. Those companies’ terms apply to their services, and we don’t control them. If they change, a product may have to change too, or lose a feature.
Buying a license
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle takes the payment, charges any tax and sends the receipt, and its Buyer Terms apply to the purchase.
The checkout shows the price, its currency and any tax before you pay. Prices may change, but a change never affects what you’ve already bought.
Once the payment completes, we email you the license key. You can find it at any time at licenses.elcano.app, by signing in with the email you bought with.
Your license
A license lets you use its product on one device at a time, for as long as you like. We license our products to you rather than sell them, and Elcano keeps every right in them.
A license is for you alone. Don’t:
- share its key, or use it on more than one device at a time
- sell, rent or lend it, or pass it on to anyone else without our agreement
- get around a product’s licensing, or help anyone else to
- change, decompile or reverse-engineer a product, except as far as the law allows
- use a product unlawfully, or to infringe anyone’s rights
Updates
A license includes every version of its product that we publish in the year after you buy it, and you keep them for good: you can install them again at any time.
After that year, your license keeps working with those versions. Versions we publish later aren’t included, so they run as the product’s free version, where it has one, until you extend your updates. You can extend them a year at a time, at the price shown when you do. Extending is up to you: your license works without it.
We decide what goes into each version.
Activation and devices
Our products check their license with our server. Activating one on a device needs an internet connection, and the product checks in again from time to time. Between checks, it keeps working offline for a while.
You can move your license to another device whenever you like, by releasing the old one in the app or at licenses.elcano.app. To stop keys being shared, we may limit how often a license moves, and free a device that hasn’t checked in for a long time. If a limit gets in your way, write to us.
Refunds
Every purchase comes with our 30-day money-back guarantee, no questions asked. Our Refund Policy says how to ask, and what happens to the license.
When a license ends
A license ends when its payment is refunded, or reversed with a chargeback, and its key then stops working.
We may also suspend or end a license, or an account at licenses.elcano.app, if it’s used in serious breach of these terms, for example to share or sell a key, or where that’s needed to stop fraud or protect our products’ security. Where we can, we’ll tell you first and give you the chance to put things right.
Products as they are
We build our products with care, and describe them as accurately as we can. Beyond that, we provide them as they are: we don’t promise that a product will suit your purpose, work without errors or interruptions, or keep working with future versions of other companies’ systems, services and devices.
This doesn’t affect your rights under consumer law, for example if a product doesn’t work as we described it.
Liability
As far as the law allows, Elcano isn’t liable for any loss or damage that comes from using the site or relying on its content. For a product, our liability is limited to what you paid for it, and we aren’t liable for indirect loss, such as lost profits or data.
None of this limits liability for wilful misconduct or gross negligence, any other liability that the law doesn’t allow us to limit, or your rights as a consumer.
Privacy
Our Privacy Policy explains how we handle personal data: on our websites, when you buy and use our products, and when you write to us. Paddle handles your payment details under its own privacy notice.
Changes to these terms
We may update these terms. The date at the top of this page shows when they last changed. The version here when you use the site applies to that use, and the version here when you buy a license applies to that license.
Law and disputes
These terms are governed by the laws of the Republic of Turkey. The courts and enforcement offices of Istanbul have jurisdiction over any dispute about them. If you’re a consumer, you keep the rights that consumer law gives you, including where you can bring a claim.
Languages
These terms are published in English and Turkish. If the two differ, the Turkish version prevails.
